As early as 2020 and as recently as January of 2025, the Kansas Supreme Court has interpreted The Kansas Parentage Act to allow same-sex mothers and biological grandfathers to be parents simply because they “notoriously” declare that they are the parent. In doing so, the Court expands the presumption of paternity and arguably gives greater recognition to the “intent” to be a parent than to biology.
In this 2-hour CLE we will explore what this precedent means for parental rights, for grandparent visitation rights, and for the children caught in the middle.
